Lindsay’s lawyer pushes onward
Lindsay Lohan’s lawyer, after doing so well for her during the DUI hearings, has now pushed forward with the 2005 car crash.
Lindsay Lohan’s lawyer filed a 10-page brief last Friday in a move to dismiss all or part of the negligence suit against her for the Oct 4, 2005 car crash. The owner of the van, Ortega, hit claims that Lindsay was drunk - Lindsay’s lawyers are countering, saying that the man is calling her drunk in order to force a settlement. Just like Ortega’s lawyers are trying to call the police report "heresay."
Ortega sued Lohan and West Hollywood hotspot the Ivy on June 14 for at least $200,000 in damages, alleging in his complaint that the Georgia Rule star got tipsy during lunch at the celebrity watering hole and then, as she was looking over her shoulder and recklessly barreling north on Robertson Blvd., smashed into his vehicle with her Mercedes.
"These are nothing but inflammatory statements," Gerisch’s brief states. "The mere presence of this type of allegation in the complaint is an attempt to embarrass [Lohan] with false allegations in order to use it as a battering ram to force a settlement."
Once again, Gerisch cites the Los Angeles County Sheriff’s Department’s report on the incident, which states that alcohol was not a factor in the crash and that Ortega was at fault for hooking an illegal U-turn right in front of Lohan, who was referred to as an "innocent victim" at the time.
Ortega’s attorney, Robert G. Klein, has criticized Gerisch for using the police report as so-called evidence, calling the document hearsay. Klein stated in a recent court filing that he has witnesses who will testify that Lohan was speeding and was served alcohol "shortly before the accident."
The hearing will take place on Tuesday.

If i ever had trouble with the law, i’d hire this lawyer with no doubts. And many people said Lindsay is unlucky, so now ? It’s just her luck.

this ‘lawsuit’ is a waste of the courts time,and trust me,the judge will dismiss it,since any ruling in favor of that ortega clown(he is a guest worker non-citizen who did not have a U.S. driver license at the time of the accident.)will undermine the authority of the officer on the scene,to make a judgement and report based on what he or she observed at the scene.another clownsiut bites the dust,stay tuned…..peace

Lindsay has said in past interviews that her lucky number is seven.well,she got seven misdemeanors instead of any felonies,and that is lucky since felonies will screw up your resume,keep you from voting or owning firearms in some states,and is a stigma that follows you for life.also,she has had a total of seven lawsuits against her,either dismissed or pending.let’s review-
1) suv passenger from july 24 madness PENDING
2) ortega/ivy accident 2005 PENDING
3) NY paparazzi ‘run-over’ 2007 PENDING
4) NY mother who ’saw’ LL drinking,almost hit her,blah,blah,blah…mar 2007 PENDING
5) 2005 accident,same as above,but owner of parked van hit after collision with ortega after he made an ILLEGAL u-turn DISMISSED MAY 2007
6) music producer who is suing dina also names Lindsay since her name is on cashed check,and she is listed as co-trademark holder LLROCKS,ltd,the name on check. PENDING
7) partner of above producer is also suing dina for breach of contract in separate lawsuit,has also named Lindsay in his lawsuit since she was the music property in question and did not fulfill the terms of the signed contract. PENDING
interestingly,the tmz ‘three stooges’ have not filed any motion in civil court or an actual lawsuit through their attorney.i believe the lawyer knows that it would be an uphill struggle to prove that Lindsay was actually driving since the two clowns that were in the suv,were the only two ‘witnesses’,their word against her.no contest is NOT an admission of guilt,it is neither a denial or an admission.in the ortega case,since the OFFICIAL police report says that unlicensed ortega was at fault,no alcohol involved,the attorney is bluffing,trying to make Lindsay settle out of court before the trial date,as there are no ‘witnesses’,lol,these ‘witnesses’ would have spoken to the press or trashloid media IN THE LAST TWO AND A HALF YEARS!!! nice try,shyster.i wish miss Lohan the best of luck in her battle with these money-grubbing jackals.love you,Lindsay.love always,a huge fan and friend.peace
