It appears at present that this is some good news developing on the legal case. There is some talk of the DA not pressing the felony changes but going with the two DUIs and the driving on a suspended licence. I’m a bit nervous that the knee jerk press reaction could hurt us here but I hope not. It’s also possible that if certain charges are dropped it may be nothing more that the fact that they have problems with their case and after all Lindsay is hardly someone that need to be locked up.

I’m wondering if the leak is from the police who are trying to push the DA to go for more serious charges. Or, it could just be the DA testing the waters to see how it will play.

Lindsay was charged with driving on a suspended license in the second incident.i bet i know why.when i had my dui/crash,my license was automatically suspended for seven days.i had to go pay a 75 dollar reinstatement fee so i could drive in the five months before i went to court for the dui.in Lindsays case,i believe that because she went to promises rehab right after the may dui,she never went to the dmv to get her license back.your lawyer cannot pick it up for you,you have to pay the fee and sign for your confiscated license.also,the judge at Lindsays first court appearance cannot use the knowledge of her second dui against her,as she is not CONVICTED of that offense.first time dui does not get jail,only fines,classes,and high insurance/sr-22,etc.if Lindsay dodges a bullet on a lot of the charges,i sincerely hope that she takes advantage of her second chance and gets clean,and gets on the right path to getting her career and reputation back.i do want the best for that young lady and wish her the best of health and clarity of mind,and stick with the program.get a sponsor and some real friends.love you,Lindsay.love always,a huge fan and friend.peace

Right ON Deep Background!! And Kudo’s to you too Dave!! See in many more words, with better terms you spelled out what I was trying to say about the possible inadmission of evidence not garnered at the scene,(1) because the search wasn’t done at the time of the arrest, and (2) the arrest itself was on faulty premises, so the whole case could go away on technicalities !! Thats why the other people involved were trying SO hard to tie Lindsay to the Stearing Wheel, Because without it, THEY Havent got a case either!! If Nigro was the Driver, then he had the responsibility to say no when an Inebraited Lindsay convinced him to chase the other car, so regardless of Lindsay’s pleeding, or convincing, it all comes down to the Driver’s responsibility to not make that kind of judgement call. Ergo, Ultimately it is HIS fault that the chase took place at all, He had the responsibility of just ( ha-ha) Saying NO. and Didn’t !! So the Civil suit against Lindsay ALSO HAS NO LEG TO STAND ON, if she wasn’t driving !!!!! HAHAHAHAHAHAHAHAAAAAAAAA!!! ( evil laughter echoing in background ) They aren’t rich, so the Plaintiff Rice might as well sue a Turnip, Thus the concerted effort to prove it was Lindsay doing the driving, It all comes down to MONEY in the end. Do you wonder WHY I am so disgusted with that crowd???

That’s some very good analysis of the situation “Rachel”. One other thought on the July 24 incident. If in fact the police can’t prove that Lindsay was driving the GMC SUV I wonder if the drug change will stick for the following reason. The police might have searched her at the scene for probable cause but the didn’t. If the arrest was a mistake then would the evidence obtained during booking at the police station be admissable? I’m not a lawyer but for example if a house is searched with a faulty warrent the evidence obtained is thrown out. She just might escape on a techicality on the felony drug charge.

I agree she needs to get her life in order and I don’t think jail will really help her. She is really a good person and I wish her the best.

no one saw Lindsay DRIVING the suv other than the tmz ‘three stooges’,their word against hers.

none of the tmz ‘three stooges’ have filed formal charges with the POLICE,but rather,are awaiting their payday in civil court(no cops,duh!!!!)

neither the ex-assistant or her mother have yet filed formal charges or a lawsuit.odd

no one saw Lindsay DRIVING in the first dui in may,and it is 99.9% unlikely that ronson or male passenger will testify since it is not a jury trial.

coke charge from may will likely be dropped in favor of the july coke charge since the coke was on her person,whether it was hers or not.the first coke charge would have been hard to prosecute since anyone could have put the coke in the convertible before the cops got there,almost two hours later.

cali has a drug diversion program,that Lindsay will most likely enroll in,since successful use of that program will result in dismissal of felony charges at end of probation.

hit and run,and leaving the scene will most likely be dropped since no other vehicles or people were involved,she was the only injury,and she DID go right to the hospital.prosecutors always go for the sure charges.it is odd that they haven’t offered her a plea bargain deal like vick.

how do they prove intent in dui no.1? the cops didn’t pull her over,the car was found almost 2 hours later and no keys were in the ignition.there are no witnesses who saw her driving,no pics,no video.no case,i hope.
in closing
i hope she comes out of this with a single misdemeanor dui,license suspension,asap,aa meetings,the usual fines,and gets a chance to get in the drug diversion program,where she will have to be clean,and when she is finished with her probation,the felony charges are erased.both of her drug charges were for very small amounts,and would qualify her the monitoring program.i do sincerely hope that she gets clean and sober,and gets back in the saddle,career-wise and personally.she needs some real friends and a good man in her life.also,cut that ‘insane pyscho freak’ father out of her life for good,that guy is utterly worthless.i still give her mother credit for raising four children as a single mom,and making a few good choices along the way,so obviously dina has some redeeming qualities.just my opinions.peace

I believe that Aug 24 is just an arraignment…the entry of a plea. It’s very doubtful that it will be anything but not guilty at that point unless a deal has been reached with the DA. I really don’t expect that at this point. Also, it’s possible that Lindsay won’t appear in person but rather her attorney will enter the plea for her or even as for a delay because of Lindsay’s on going rehab.

I have thought that all along, besides through the window ?? of the Passengers Side ?? (A) How wide is an SUV ?? How High off the Ground ?? (B) How tall is Lindsay ?? How Long are her Arms ?? See details, like that are what Forensics are all about, now I am no expert in same, but even a beginner can see that NEVER added up. Why I think she paid them to drive, or convinced them to drive, not her. Puts a whole different light on the case, and makes the subsequent arrest and search,,,, all,,, Illegal. Too many Loose edges. Clear Demonstration of culpable guilt never gonna get made here. You GO Lindsay !! Now you just need to get through the Court Hearing on the 24th. coming Up Fast. Like A freight train of Destiny. But I think you’ll be OK, I have Prayed for You. Dante got back in the SUV which undermines his carjacking claims(if they ever had any merit) as if he was in the vehicle under duress and had jumped out why would he get back into it? One possibility is that he was driving and was a willing participant in the events of that night. Since he had too much to drink that night and planned to have his friend (Ms. Peck’s daughter’s boyfriend) drive them home when the police showed up it’s possible that he claimed Lindsay was driving to avoid arrest himself. Certainly that might give him a motive and his buddy in the back seat supported him. One open question is just what surveillance video there is concerning these events?

The TMZ-3’s story itself has some problems such as the claim that Lindsay somehow grabbed the keys of the SUV by reaching in the window from the passenger side and then was allowed to run around the front of it, get in and drive off against the will of the three passengers. It seems more likely that if Lindsay approached it from the passenger side she might have asked Dante to follow the assistant for some reason and orginally he agreed. After she had invided him to the party, shared a drink with him, and who know exactly what he was thinking might happen later. If you chose instead to believe the “3″ they sure have her doing some incredible driving with a blood alcohol level above .12 in a rather large vehicle. Speeds of up to 100 mph and doing doughnuts around the assistants car? My ideas are pure conjecture but if Dante was driving the story makes more sense.
